Continental Airlines International Restaurant Week
The following terms and conditions (these "Terms and Conditions") contain important information regarding the Continental Airlines Inc.'s ("Sponsor") International Restaurant Week program (the "Program"). Please read the following Terms and Conditions carefully. These Terms and Conditions are a binding agreement between you and Sponsor and will govern your participation in any and all Program offers.
Continental Airline's International Restaurant Week will take place starting at 11:30am ET on May 1st, and ending at 11:59pm ET on May 10th, 2009 ("Promotion Period"). ALL PROGRAM DISCOUNTS AND GIFTS WILL BE AVAILABLE AT EACH PARTICIPATING RESTAURANT (DEFINED BELOW) DURING THE PROMOTION PERIOD SOLELY DURING DINNER HOURS OF SERVICE. All Program discounts and restaurant provided take-home gifts (“Gifts”) are also subject to all applicable restaurant black out dates and specific hours of operation for each restaurant dinner service at each Participating Restaurant.
Being eligible for the Program entitles eligible customers to enjoy exclusive dinner offers and experiences at select New York City restaurants detailed below ("Participating Restaurants"). By participating in the Program, you may receive Program discounts and Gifts, available for limited times, all as determined by Sponsor in its sole discretion. As part of the Program, you will need to call the Participating Restaurant and make a dinner reservation indicating you are a participant in the Program. For certain restaurants, in addition to calling the Participating Restaurant to make a dinner reservation, you will have the option of making it through an online reservation link available at continentalrestaurantweek.com. Directions to make the online reservation will be posted on the foregoing Website. These directions will instruct you on the exact steps needed to make a reservation online. You will still need to notify the restaurant that you are participating in the Program.
At a Participating Restaurant, program discounts are subject to availability (including appearances of any personnel), any applicable black out dates, and are available on a first come first serve basis only during dinner service (except where lunch options are noted) at each Participating Restaurant. Participating Restaurants shall use best efforts to accommodate all reservation requests, but cannot guarantee availability. Gifts are available only while supplies last. Sponsor reserves the right to modify these Terms and Conditions at any time, without notice to you. Participation in the Program and/or redemption of discounts and Gifts is considered acceptance of these Terms and Conditions. Sponsor may, in its sole and absolute discretion, cancel, change, suspend or modify any aspect of the Program and/or and Program discounts or Gifts at any time, including the availability of any Program discount and/or Gift, without notice.
PROGRAM ELIGIBILITY AND DATES: To be eligible for the Program, you must be 21 years of age or older. You must have internet access to register for the Program.
Gifts can only be redeemed at the Participating Restaurants detailed below during the Promotion Period subject to individual restaurant black out dates and specific hours of operation for dinner service at each restaurant. Employees of Sponsor, and any other participating entities, and their respective affiliates, subsidiaries, distributors, advertising agencies, and other agents, and any immediate family members living in the same household of any of the foregoing are not eligible for the Program. Program discounts may not be combined with any other offers.
SIGNATURE DISH CONTEST PUBLIC RATING: During the Program, each Participating Restaurant will offer a special “signature dish,” which Program diners can order and then rate and review on the Program Website. The Participating Restaurant with the “signature dish” that receives the highest rating at the end of the Promotion Period will be the contest winner. To rate and review a “signature dish,” you must visit www.continentalrestaurantweek.com/signature-dish and follow the rating instructions. You may rate and provide a review for each “signature dish” one time only. While on the Website you may also provide comments on the ratings and/or reviews submitted by other users. There is no limit on the number of comments you may submit. For purposes of the contest, all ratings must be received by 11:59 pm ET on May 10, 2009. Any attempt to rate other than as described herein shall be null and void. By posting a review and/or comment you consent to the use of your review/comment in accordance with these Terms and Conditions including granting permission to Sponsor to display your review/comment on the Website for public viewing. Further, you grant to Sponsor and Participating Restaurants an irrevocable, nonexclusive, perpetual, worldwide, royalty-free right and license to use, display, modify, reproduce, publish, distribute, make derivative works of, and otherwise commercially and non-commercially exploit your review/comment. Reviews/comments that include obscenities, racially or ethnically offensive content, content that defames any person or company, or content that contains any material deemed objectionable by Sponsor, may be removed from the Website at the sole discretion of Sponsor.
PROGRAM TERMINATION: Sponsor may, in its sole and absolute discretion, cancel, change, suspend or modify any aspect of the Program and/or any Program discount or Gift at any time, including the availability of any discount or Gift, without notice. Sponsor may, in its sole and absolute discretion, terminate or suspend any individual's participation in the Program for breach of these Terms and Conditions, or for taking any actions that are inconsistent with the intent of these Terms and Conditions. Sponsor shall be the sole determiner in cases of suspected abuse, fraud, or breach of these Terms and Conditions or intent of these Terms and Conditions. Any decision Sponsor makes relating to termination or suspension of any individual's participation in the Program shall be final and binding in all respects.
GENERAL: Gifts are redeemable only at the Participating Restaurants in New York City, New York. The Program is void where prohibited by law. Sponsor is not responsible for any failures or circumstances affecting, disrupting or corrupting the Program or distribution/redemption of the Gifts in any manner. Sponsor is not responsible for unavailable network connections; failed, incomplete, garbled or delayed computer transmissions; online failures; hardware, software or other technical malfunctions or disturbances; or any other communications failures or circumstances affecting, disrupting or corrupting the Program in any manner and Sponsor is also not responsible for any damage to any participant's computer occasioned by participation in the Program or downloading of any information necessary to participate in the Program. Sponsor cannot be held responsible for any restaurant ceasing to participate in this Program or altering the terms of its participation in this Program or denying participant a Gift or denying admission to any person to the restaurant for any reason. Neither Sponsor nor its agents or Program partners shall be held responsible for any disagreement concerning any individual Program discount or Gift, nor accept any liability whatsoever for personal loss or injury at any restaurant. Any dispute must be settled directly with the Participating Restaurant concerned. By participating in the Program, all participants release Sponsor, Participating Restaurants, and any other participating sponsor or partner, and their respective parent companies, subsidiaries, affiliates, suppliers, and agents from any and all liability for any loss, harm, damages, cost or expense, including without limitation property damages, personal injury and/or death, arising out of participation in the Program and the use of any Gifts and any of the restaurant's products or services. Sponsor makes no warranty in any respect as to any Gifts or other merchandise or services available within the Program. Under no circumstance will merchandise or any service be refunded or exchanged for other offers, discounts or cash. Gifts may be taxable, depending on the value of the item and the federal, state, and local tax laws applicable to you. Participants are solely responsible for reporting such items on their respective tax returns and paying any associated tax liability. Participants are also responsible for any other expenses including without limitation, gratuities, transportation, and any other expenses not specifically state herein. Participants may not assign or transfer any Gifts. Sponsor is not responsible if the Program cannot take place or if any Gifts cannot be awarded or redeemed due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.
Personal nonpublic information that we gather from you in connection with the Program or otherwise will be governed by our Privacy Policy found at http://www.continental.com/web/en-US/content/privacy.aspx. By participating in this Program you hereby agree to Sponsor's collection and usage of your personal information and acknowledge that you have read and accepted Sponsor's privacy policy.
INDEMNIFICATION: You agree to indemnify, defend and hold Sponsor and its representatives and agents harmless from and against any and all third party claims, demands, liabilities, costs or expenses, including attorney's fees and costs, arising from, or related to any breach by you of any of these Terms and Conditions or any violation by you of applicable law.
PARTICIPATING RESTAURANTS: All Program discounts and Gifts are subject to these Terms and Conditions, which include the terms and limitations of each Participating Restaurant as set forth below. All of the offers below can only be redeemed during the Promotion Period subject to black out dates and only during each restaurant's specific hours of operation for dinner service. Any meet and greets provided are subject to availability.
1) Alfama
Experience an authentic 4-course meal ($55), ending with a glass of port from Alfama's extensive collection, included with your meal. You'll also take home a box of six (6) Pasteis de nata, traditional Portuguese custard cakes.
2) Allen & Delancey
After enjoying Chef Kyle Bailey's 5-course meal ($78) and specially designed signature dish you'll feel inspired to recreate the experience. Savor the taste of Allen & Delancey at home, with Chef Bailey's signature dish recipe and a package of couscous.
3) Avra
For a truly personalized experience, a manager will help design a menu based on your likes and dislikes, providing insights into the menu including wine pairings. After enjoying this wonderfully individualized meal, take home some Greek delicacies chosen by Avra to savor at home.

4) Boqueria
Get the true VIP experience - priority reservations at the hottest spot in town. While you're there, get to know Chef Seamus Mullen as you enjoy his specially designed shared tasting menus - for lunch or dinner. And don't forget to take home your bag of house-made candied Marcona almonds.

5) China Grill
Enjoy an exclusive 5-course tasting menu created by Chef Jamie Knott, with a specially paired cocktail included in the meal. Take home a box of delicious ginger and almond cookies.
6) Delmonico’s
Enjoy an exclusively designed prix fixe menu featuring Delmonico's famous dishes, with an optional wine pairing to match. Take a personal tour of the restaurant, a National Historic Landmark and take home a complimentary signed copy of the cookbook Dining at Delmonico's.

8) L’Ecole
Start your evening with a behind the scenes look at L'Ecole's teaching kitchens. Then indulge in a unique Continental dessert and cocktail featuring rare Grapefruit Thai Basil Tea, included with your meal. Take home a sample of the exotic tea along with the recipe.
9) Maya
Chef Sandoval offers a uniquely designed 3-course Cinco de Mayo menu with special beverage pairings ($70-$90). And don't leave without taking home a complimentary signed copy of his cookbook Modern Mexican Flavors.
10) Nobu
Let Nobu's talented chefs kick start your meal with a complimentary Chef's Selection Amuse-Gueule. And finish on a sweet note too, with a signature fruit sake or shochu, included with your meal.

Savor an exclusively designed 4-course prix fixe menu with an optional wine pairing to match. Take a personally guided tour of Tabla's kitchen and take home one of Pastry Chef Melissa Walnock's uniquely designed desserts, packaged along with the recipe.

GOVERNING LAW: The laws of the State of New York shall govern these Program terms and conditions. You hereby expressly consent to exclusive jurisdiction and venue in the courts located in New York for all matters arising in connection with these Program terms and conditions or your access or use of the Program.
